Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kitchen & Bath Sales OS (“the Service”), operated by TradeLynQ (“TradeLynQ,” “we,” “us”). By accessing or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

1. Accounts

You are responsible for the activity that occurs under your account and for keeping your credentials secure. You must provide accurate information and promptly update it as needed. You must be at least 18 years old to use the Service.

2. Acceptable use

You agree not to misuse the Service, including by attempting to access it through means other than the interfaces we provide, interfering with its operation or security, uploading unlawful or infringing content, or using it to send unsolicited communications in violation of applicable law.

3. Customer data

You retain ownership of the content and data you submit to the Service. You grant us a limited license to host, process, and transmit that content solely to provide and improve the Service. You are responsible for ensuring you have the rights and any necessary consents to submit content, including measurements, photos, and client information.

4. Third-party integrations

The Service may let you connect third-party services, such as Google, for sign-in, calendar, and meetings. Your use of those services is governed by their own terms and policies. Connecting an integration authorizes us to access the relevant data on your behalf as described in our Privacy Policy. You can disconnect an integration at any time.

5. Fees and billing

Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. We may change pricing on prospective notice. Failure to pay may result in suspension or termination of access.

6. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, add, or discontinue features over time. We will make reasonable efforts to notify you of material changes that adversely affect your use.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be error-free or meet your specific requirements.

8. Limitation of liability

To the maximum extent permitted by law, TradeLynQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim will not exceed the amounts you paid us for the Service in the twelve months before the claim arose.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk or legal exposure. Upon termination, your right to use the Service ceases, subject to provisions that by their nature survive.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
